昆山反殺案效應／防衛過當認定 最高院擬放寬 Sep 19th 2018, 08:50 在中國司法案例中，法院很少承認正當防衛，多數認定為防衛過當或故意傷害。最高人民法院日前發布「關於在司法解釋中全面貫徹社會主義核心價值觀的工作規畫」，將提出防衛過當的認定標準，鼓勵正當防衛，保護見義勇為者的合法權益。
